Terms of Use

These Terms of Use ("Terms") govern your use of the ToyColor mobile application ("App") operated by David Wilson ("we", "our", "us"), based in New Zealand. By using the App, you agree to these Terms.

Using ToyColor

ToyColor lets you photograph toys and convert them into printable coloring pages using AI. You may use the App for personal, non-commercial purposes. You must be at least 13 years old to create an account. If you are under 18, you should review these Terms with a parent or guardian.

Accounts

You may create an account using Apple Sign In or Google Sign In. You are responsible for maintaining the security of your account. You may delete your account at any time from the app settings. We may suspend or terminate accounts that violate these Terms.

Subscriptions and Payments

Free tier: New users can generate up to 10 coloring pages for free when they first sign up. After that, free users can generate up to 3 coloring pages per rolling 30-day period at the Simple complexity level at no cost.

ToyColor Premium: A paid subscription that provides up to 50 coloring pages per rolling 30-day period, access to all complexity levels (including Detailed), and additional features.

Pricing: ToyColor Premium is available as a weekly plan at NZ$4.99/week (or local equivalent) or an annual plan at NZ$79.99/year (or local equivalent). Prices may vary by region and are displayed in your local currency before purchase. We may change pricing with notice; any price change will apply to the next billing cycle after notification.

Free trial: Premium subscriptions include a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable subscription price.

Billing: Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You can cancel your subscription at any time through your device settings (Settings > [your name] > Subscriptions) or via Apple's subscription management page. Cancellation takes effect at the end of the current billing period. You retain access to Premium features until then. No partial refunds are provided for unused time.

Refunds: Refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com.

Your Content

You retain ownership of the photos you take and the coloring pages generated from them. By using ToyColor, you grant us a limited license to process your photos through AI services solely for the purpose of generating coloring pages. Generated coloring pages are for personal, non-commercial use only, including printing and sharing with family and friends.

Intellectual Property and Trademarks

You are responsible for the content you photograph and submit. ToyColor is designed to create original coloring page illustrations inspired by the shape and form of your photos. The AI is instructed to remove logos, brand names, trademarks, and copyrighted symbols from generated output. However, no automated system is perfect, and we do not guarantee that all protected marks will be excluded from every result.

You agree not to use ToyColor to intentionally reproduce, distribute, or commercially exploit coloring pages of copyrighted characters, trademarked designs, or other intellectual property you do not own or have permission to use. You are solely responsible for ensuring your use of generated content does not infringe the rights of any third party.

AI-Generated Content

Coloring pages are generated using third-party AI services. Our primary provider is xAI (Grok), with Google Gemini as a fallback. Your photos are transmitted to these providers' servers in the United States for processing. The AI transforms your photos into simplified black-and-white line art — it does not reproduce source material verbatim. AI-generated results may not always be perfect. We do not guarantee the quality, accuracy, or suitability of AI-generated content. Generated content is provided "as is".

Service Availability

We strive to keep ToyColor available at all times, but we do not guarantee uninterrupted access. The App depends on third-party AI services that may occasionally be unavailable. We may modify or discontinue features with reasonable notice.

Limitation of Liability

To the maximum extent permitted by applicable law, ToyColor is provided "as is" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms excludes or limits any consumer rights that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993.

Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts of New Zealand.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.
