These Terms of Use ("Terms") govern your use of the ToyColour mobile application ("App") operated by David Wilson ("we", "our", "us"), based in New Zealand. By using the App, you agree to these Terms.
ToyColour lets you photograph toys and convert them into printable coloring pages using AI. You may use the App for personal, non-commercial purposes. You must be at least 13 years old to create an account. If you are under 18, you should review these Terms with a parent or guardian.
You may create an account using Apple Sign In or Google Sign In. You are responsible for maintaining the security of your account. You may delete your account at any time from the app settings. We may suspend or terminate accounts that violate these Terms.
Free tier: All users can generate up to 3 coloring pages per rolling 7-day period at the Simple complexity level at no cost.
ToyColour Premium: A paid subscription that provides up to 50 coloring pages per rolling 30-day period, access to all complexity levels (including Detailed), and additional features.
Pricing: ToyColour Premium is available as a weekly plan at NZ$4.99/week (or local equivalent) or an annual plan at NZ$79.99/year (or local equivalent). Prices may vary by region and are displayed in your local currency before purchase. We may change pricing with notice; any price change will apply to the next billing cycle after notification.
Free trial: Premium subscriptions include a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable subscription price.
Billing: Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
Cancellation: You can cancel your subscription at any time through your device settings (Settings > [your name] > Subscriptions) or via Apple's subscription management page. Cancellation takes effect at the end of the current billing period. You retain access to Premium features until then. No partial refunds are provided for unused time.
Refunds: Refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com.
You retain ownership of the photos you take and the coloring pages generated from them. By using ToyColour, you grant us a limited license to process your photos through AI services solely for the purpose of generating coloring pages. You may use generated coloring pages for personal purposes, including printing and sharing with family and friends.
You are responsible for ensuring you have the right to photograph and use any subjects in your photos. Do not use ToyColour to process copyrighted characters or content you do not have permission to use.
Coloring pages are generated using Google Gemini, a third-party AI service. Your photos are transmitted to Google's servers for processing. AI-generated results may not always be perfect. We do not guarantee the quality, accuracy, or suitability of AI-generated content. Generated content is provided "as is".

We strive to keep ToyColour available at all times, but we do not guarantee uninterrupted access. The App depends on third-party AI services that may occasionally be unavailable. We may modify or discontinue features with reasonable notice.
To the maximum extent permitted by applicable law, ToyColour is provided "as is" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms excludes or limits any consumer rights that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993.
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts of New Zealand.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.
